Work visa in the United States

For several years now, there has been a trend among Ukrainians to go abroad in search of a “better life” and the opportunity to apply their talents in various fields at foreign enterprises. One of the most popular countries for these purposes is America. There is still a high demand for skilled workers in many fields in this country. However, to work in the United States of America legally, a work visa to the USA is required for departure from Ukraine.

Working in the USA without a work visa is impossible, as citizens holding a visitor or business visa will not be able to legally gain employment. In such a case, you would be considered a violator and risk being deported from the country, as well as receiving a ban on entry.

To obtain permission to enter this country, you will have to undergo a rigorous selection process, as some visa categories are subject to quotas and are issued in strictly limited numbers.

Types of work visas in the USA:

H Visa in the USA


H1B Visa
Intended for highly qualified specialists who can offer the host country high-level services and knowledge (e.g., doctors, economists, architects, engineers, etc.). The applicant must have at least a bachelor’s degree or its equivalent.
H2A Visa
Issued to those workers who wish to temporarily engage in seasonal agricultural work (e.g., harvesting vegetables or fruits).
H2B Visa
Intended for unskilled workers, both with and without a specialty (service staff, assistants to more qualified American workers).
H3 Visa
Issued to trainees who wish to gain relevant qualifications during their work. This type of work visa to America for Ukrainians is not issued for professions such as doctor and teacher.
H4 Visa
Issued to the spouse and children if they wish to accompany and stay with the holder of any of the above visas in America. To obtain this visa, the spouse and child must have documents proving the family relationship.

L Visa in the USA


L1 Visa in the USA
This L visa in the USA is intended for employees of companies or enterprises who are being transferred to work at a branch, division, or subsidiary located in America. The applicant must have worked continuously for the relevant company for at least one year within the last three years preceding the visa application. With this entry permit, the worker can live and work in America on a permanent basis for up to 7 years. An L1 visa allows for future Green Card eligibility, enabling long-term residence and employment in the country.
L2 Visa in the USA
Intended for the spouse or children of the L1 visa holder who wish to live abroad with them. Notably, the spouse can work in America on this visa, but the children cannot.

O Visa in the USA


O1 Visa
For individuals with extraordinary abilities in the fields of science, arts, education, sports, film and television, or business who are coming to continue their work. This visa requires national or international recognition and meeting specific criteria.
O-2 Visa
Required for accompanying individuals to assist the O-1 visa holder during a cultural or sporting event. This type does not apply to scientists, business professionals, or educators.
O-3 Visa
Issued to spouses and children who wish to join the O1/O2 visa holder. Holders of this visa category are not permitted to work in the United States.

P Visa in the USA


P-1 Visa
Issued for participants in international competitions, as well as their accompanying persons. Additionally, this visa applies to performances by entertainment groups recognized on the global stage.
P-2 Visa
Granted to artists or cultural figures, both solo and groups, planning to visit America under a reciprocal exchange program between countries.
P-3 Visa
Suitable for artists or entertainers traveling to the United States individually or as part of a group for performances, teaching, or training as part of a specific cultural program.
P-4 Visa
Issued to trainees who wish to gain relevant qualifications during their work. This type of work visa to America for Ukrainians is not issued for professions such as doctor and teacher.

R-1 Visa
For religious workers authorized by a recognized religious organization to conduct religious ceremonies, as well as individuals engaged in religious activities.
R-2 Visa
Intended for family members of the R-1 visa holder. They are not permitted to work. However, children may receive any education in a U.S. school or college. All R-2 visa holders must leave the United States no later than the R-1 visa holder.

Q, J Visa in the USA


Authorization for workers who have come to the States for international cultural exchange, the main purpose of which is practical training, employment, and immersion in history, culture, and traditions. The J category visa provides opportunities for cultural and educational exchange under the U.S. Department of State program, while the Q-1 visa offers similar opportunities through the U.S. Citizenship and Immigration Services (USCIS).

To obtain a work visa, you must secure an appropriate invitation or contract from an American employer and receive approval of the I-129 petition, which is filed by your prospective employer with the U.S. Citizenship and Immigration Services (USCIS). The petition review process takes approximately 2 weeks to 6 months. If a positive decision is made, the employer will receive a notification, after which you can proceed with obtaining the work visa.
