EB-1 Green Card for Talented People – Criteria and How It Differs from the O-1
EB-1 is the first employment-based green card category, meant for people who already stand out in their profession. Its EB-1A subcategory needs no employer – you petition for yourself if you meet three of ten criteria and pass the USCIS final merits review. Below – how to read those criteria, how EB-1A differs from the O-1 visa and when it makes sense to move from one to the other. If you want the petition prepared for you, see our EB-1 green card service.
O-1 or EB-1A – the difference
| O-1 | EB-1A | |
|---|---|---|
| Result | work visa, up to 3 years | green card |
| Who files | US employer or agent | you |
| Criteria | 3 of 8 (O-1A) or 3 of 6 (O-1B) | 3 of 10 plus final merits |
| Consultation letter | required | not required |
| Work in the US | for the petitioner only | in your field, for anyone |
The definition of extraordinary ability for the O-1A and EB-1A is almost the same – one of the small percentage at the top of the field. What differs is the cost of a mistake. An O-1 covers one job for a set time, EB-1A is permanent, so the final review is stricter and the evidence has to show acclaim that has lasted, not a single good year.
The ten EB-1A criteria and where people trip
The criteria are listed in 8 CFR 204.5(h)(3). You need one major international award or three of them. We grouped them by what the evidence usually looks like.
Awards and memberships. National or international prizes for excellence and membership in associations that admit people for outstanding achievement, as judged by experts. Student and in-house company awards rarely count, and pay-to-join memberships never do.
Press about you and judging. Coverage of your work in professional or major media, with author and date; serving on juries; peer review. An interview where you talk about your company is weaker than a reporter’s piece about your result.
Contributions and scholarly articles. An original contribution of major significance – a method, tool or product others rely on. This needs proof of impact – citations, adoptions, licenses – not just proof that the work exists.
Role, pay and display. A leading or critical role at a distinguished organization, a high salary compared with peers in the same country, exhibitions and commercial success in the performing arts. Pay is compared with market data, not with the person at the next desk.

Final merits – what the officer checks after the three criteria
Since 2010 USCIS has reviewed EB-1A petitions in two steps. First the officer decides whether three criteria are formally met. Then the whole record is weighed – does it show sustained national or international acclaim and a place among the top of the field?
Most denials happen at step two. A typical pattern – three criteria are met, but all the evidence comes from one year or one employer. The officer sees a spike, not a career. That is why the petition needs a timeline – what happened five years ago, what is happening now, and why you will keep going in the same direction in the US.
One separate requirement remains – showing that you are coming to continue work in your field. Letters from prospective employers, contracts or a work plan will do. A job offer is not required.
EB-1B and EB-1C in brief
EB-1B is for professors and researchers with international recognition and at least three years of teaching or research. A US employer files for a permanent position; there are six criteria and you need two.
EB-1C is for executives and managers transferred to the US company of the same multinational group. You must have managed abroad for at least one of the last three years, and the US company must have been doing business for at least a year. It often follows an L-1 visa.

EB-1A pros and cons
People choose EB-1A for speed and independence, but it carries the highest evidentiary bar of the employment green cards.
Pros
- no employer needed
- no PERM labor certification
- no Visa Bulletin backlog for most countries
- your family immigrates with you
- you can work for any employer in your field
Cons
- a demanding final merits review
- evidence takes months to gather
- fees are not refunded on denial
- without a strong timeline the case reads as one lucky break
Moving from O-1 to EB-1A
A common path is to enter on an O-1, work in the US for two or three years, and file EB-1A once new evidence has built up – US press, judging invitations, higher pay. You do not need your O-1 employer for this; you file the petition yourself.
If you are in the US in O-1 status and a visa number is available, Form I-485 can be filed together with the I-140, and you can keep extending your O-1 while it is pending.
Dual intent and the O-1
For many work visas, a green card filing raises an intent problem. The O-1 does not have one – the regulation says an immigrant petition is not a reason to deny an O-1 or its extension. More on the visa itself in our article on how to get an O-1 talent visa.
Timing and government fees
In the November 2026 Visa Bulletin, EB-1 is current for every country except China and India. An EB-1A I-140 can be premium processed within 15 business days. What happens next depends on where you are – adjustment of status in the US, or consular processing through the National Visa Center.
USCIS fees – I-140 $715 plus a $300 Asylum Program Fee for self-petitioners, $2,965 for premium processing, I-485 $1,440. The consular immigrant visa fee is $345 per person. Amounts follow the USCIS fee schedule G-1055 as of October 2026.
Before filing, pick your three or four strongest criteria and check their timeline. If everything happened in the last year, it may be wiser to wait or to look at EB-2 NIW in parallel.
EB-1 green card questions
Can I get EB-1A without awards?
Yes. Awards are one criterion out of ten. Many cases rest on press about the person, judging, contributions and a role at a well-known organization.
Do I need a US degree or English test?
No. A degree from any country works if documents back it up, and there is no language requirement.
How many expert letters do I need?
There is no set number. Five to eight is common, and who writes matters more than how many. An independent expert who knows your work through its results outweighs several colleagues.
If EB-1A is denied, can I file EB-2 NIW?
Yes. It is a different category with different requirements, and some of the evidence carries over.
I live in Canada. Can I file from there?
Yes. EB-1A can be filed from any country. If you are not adjusting status in the US, the immigrant visa interview for residents of Canada is held in Montreal.
