Form I-751 – Removing Conditions on a Marriage Green Card
If you got your green card through a marriage that was less than two years old, the card is conditional and valid for 2 years. To get a regular 10-year card, you and your spouse file Form I-751 with USCIS during the last 90 days before the conditional card expires. We work out your filing window, build the evidence of your life together and prepare the petition, and after a divorce we file it with a waiver request. Lawyer fees start at $950, and the USCIS fee is paid separately.
What we handle
- Work out the first and last day of your window
- Gather evidence for the whole marriage
- Prepare and file I-751 online or by mail
- Answer USCIS requests and prepare you for the interview
Who files I-751 and when
You need this form if you hold a conditional green card obtained through marriage to a U.S. citizen or a green card holder. Status is conditional when the marriage was less than two years old on the day you entered on an immigrant visa or on the day USCIS approved your I-485. On the visa this category appears as CR-1.
- if you are still married, you file jointly during the 90 days before the expiration date on the card;
- a petition filed before the window opens will be rejected, and you will have to file again;
- children who got conditional status with the parent, or within 90 days after, are included in the parent’s petition;
- after a divorce, a spouse’s death or abuse, you file on your own with a waiver request and do not have to wait for the window.
Missing the window is the costliest mistake. If I-751 is not filed on time, conditional status ends automatically on the second anniversary and the case can be referred to removal proceedings. A late filing is accepted only with a written explanation of good cause, and USCIS decides whether it is enough.
Not sure your window is open?
Send us the expiration date on your card. A lawyer will tell you when to file.
How we handle removal of conditions
Date and route. We use the date on your card to set the filing window. We check whether you file jointly or need a waiver, and whether children have to be included.
Evidence. We collect documents for the whole conditional period, not just the last few months – housing, finances, children, travel, letters from people who know you as a couple.
Filing. We complete I-751 and file online or by mail. The USCIS receipt notice extends your status and work authorization for 48 months, so keep it with your card.
Requests and interview. If USCIS asks for more evidence, we prepare the response. Not everyone is interviewed, but if you get a notice, we prepare you both.

Where people slip up most
Many count the window from the wedding date. It actually runs from the expiration date printed on the card. File a week early and the petition comes back, and the time goes on refiling. The second weak spot is evidence from only the last six months. The officer looks at both years of the marriage, so joint accounts, the lease and insurance are best collected from the first month you hold the card.

Documents for Form I-751
The petition includes a copy of the conditional card and evidence that the marriage is real and you live together:
- copy of the green card, front and back, yours and your children’s if they are included
- a joint lease or proof of shared property
- joint bank accounts, loans, tax returns
- insurance listing your spouse as family member or beneficiary
- birth certificates of children you have together
- signed statements from people who know you as a couple, with their full name, address and how they know you
After a divorce, include the final divorce decree and evidence that you married in good faith – the same kind of joint-life records for the time you were married.
If your spouse died, include the death certificate. In cases of abuse, include records that support it, such as police reports, court orders, medical records or letters from professionals.
For an extreme hardship waiver, describe and document what leaving the U.S. would mean for you.
Requirements for each ground are in the form instructions on the Form I-751 page.
How long it takes and your status while you wait
I-751 reviews are slow. USCIS quarterly data for April – June 2026 shows a median of 22.6 months, so half of the petitions took longer. About 94% of decisions were approvals.
While the petition is pending, you remain a permanent resident. The I-751 receipt notice extends your status and work authorization for 48 months past the date on your card. If that is still not enough, you request proof of status through the USCIS Contact Center. Details are on the USCIS page Removing Conditions on Permanent Residence Based on Marriage.

Joint filing or waiver request
The route depends on whether the marriage is still intact when you file.
| Joint filing | Filing with a waiver request | |
|---|---|---|
| When it applies | the marriage continues | divorce, spouse’s death, abuse, extreme hardship if removed |
| Who signs | both spouses | the conditional resident |
| When to file | last 90 days before the card expires | any time before conditional status ends |
| What you prove | the marriage is real and ongoing | you married in good faith, plus the waiver ground |
If you do not have a conditional card yet, start with the marriage green card or the US spouse visa page.
I-751 FAQ
When should I file I-751?
During the 90 days before the expiration date printed on your conditional card. If you file earlier, USCIS will reject the petition. If you file with a waiver request, you do not have to wait for the window.
What happens if I miss the deadline?
Conditional status ends automatically on the second anniversary, and USCIS can start removal proceedings. You can still file late only with a written explanation of good cause, and USCIS decides whether to accept it.
How much does it cost to remove conditions on a green card?
VizaUS fees start at $950. The USCIS fee is $750 by mail or $700 online, with no separate biometrics fee.
Can I renew a conditional green card?
No, the card itself cannot be renewed. The I-751 receipt notice extends it for 48 months past the date on the card, together with your permission to work.
What if we are divorced?
File I-751 on your own with a waiver request and show that you married in good faith. You do not wait for the 90-day window – just file before conditional status ends.
Will there be an interview?
USCIS may call you to an interview at the local field office or decide without one. If an interview is scheduled and you miss it without good cause, conditional status is terminated.
When can I apply for citizenship?
Three years after getting your green card if you have been married to and living with your U.S. citizen spouse the whole time. The conditional period counts toward the 3 years. See U.S. citizenship through marriage.
