How to Remove Conditions on Your Green Card: I-751 Timeline and Evidence
A 2-year conditional green card is issued if you had been married less than two years on the day you became a permanent resident. To get a permanent card, you and your spouse file Form I-751 together in the 90 days before the card expires. Don’t miss that window – without a filed I-751, conditional status ends automatically. Below – how to count the window, what marriage evidence to send, what the receipt notice does and what to do if the marriage has ended. For help preparing I-751 and our pricing, see I-751 removal of conditions.
I-751 dates and deadlines
| What | When | Why it matters |
|---|---|---|
| Conditional card | valid 2 years from the date you got status | cannot be renewed – only I-751 |
| Filing window | 90 days before the card’s expiration | file earlier and it may be rejected |
| USCIS receipt notice | after filing | extends status and work authorization for 48 months |
| Interview | at USCIS discretion | may be scheduled or waived |
| Decision | median 22.6 months | permanent green card without conditions |
Example – a card that expires on June 15, 2028 opens its filing window on March 17, 2028. USCIS has a filing date calculator on the form page for the exact first day. The processing median comes from the USCIS quarterly report for April – June 2026.
Joint filing or a waiver
How you file depends on where the marriage stands today. There are four possible situations.
Still married. File jointly, only within the 90-day window. Both of you sign, and you send copies of both sides of the card plus evidence of your life together.
Divorced or annulled. File on your own and ask for a waiver of the joint filing requirement. You need the final divorce or annulment decree and proof that you married in good faith.
Spouse has died. File on your own with the death certificate and evidence of the marriage.
Abuse or extreme hardship. File on your own with evidence such as police reports, court records, medical records or proof of a stay at a shelter. A hardship waiver can only rely on circumstances that arose during the two years of conditional residence. A waiver petition can be filed at any time before your status ends.

What evidence of marriage to send
USCIS wants to see that the marriage was not entered into to get around immigration law, and it looks at the whole period from the wedding to filing. Send as much as you have, for example
- birth certificates of children born during the marriage
- a lease or mortgage in both names
- joint savings and checking accounts with transaction history
- joint federal and state tax returns
- insurance policies naming your spouse as beneficiary
- joint utility bills and loans
- sworn statements from at least two people who have known you both since you became conditional residents
Third-party statements must be backed by other documents. Each one needs the person’s full name, address, date and place of birth and how they know about your marriage, and the person may be asked to confirm it before an officer.
If you have ever been arrested or detained, in the U.S. or abroad, include official records for each incident – the arrest record, court disposition or a statement that no record exists.
Children who became conditional residents with you or within 90 days afterwards are listed on your petition, with copies of their cards. Other children file their own I-751.

What happens after you file
The I-751 fee is $750 by mail or $700 online. After filing you get a receipt notice. It extends your conditional status and work authorization for 48 months past the card’s expiration date, so the notice together with your card proves your status. If there is still no decision after 48 months, call the USCIS Contact Center at 800-375-5283.
USCIS may schedule biometrics, request more evidence and invite both spouses to an interview. It can also waive the interview if the file is strong enough. The median in April – June 2026 was 22.6 months, and most petitions are approved – 10,368 approvals against 626 denials in that quarter.
What helps avoid an interview
- the same address for both years
- joint tax returns
- accounts with transaction history
- detailed third-party statements
What tends to raise questions
- different addresses with no explanation
- only photos and messages
- filing before the window opens
- old arrests without court records
If you are abroad when the window opens
You can file I-751 from outside the U.S. But if USCIS schedules an interview, you need to come back for it with your spouse and children. Once the petition is filed, you can travel and return with your card and the receipt notice.
If you missed the window
If the petition is not filed in the 90 days before the second anniversary, conditional status ends automatically and USCIS can start removal proceedings. A late petition is accepted only with a written explanation of good cause. If USCIS accepts the reason and approves the petition, your status is restored.
Three years after becoming a permanent resident, if you have stayed married to and lived with your U.S. citizen spouse, you can apply to naturalize, and conditional status does not stop you. See U.S. citizenship through marriage.
Set a reminder for the first day of the window as soon as the conditional card arrives. Collect evidence of your life together throughout the two years, not in the last month – USCIS looks at the whole marriage, not the final weeks.
Removing conditions FAQ
Can I file I-751 before the 90-day window?
No. A joint petition filed before the first day of the window may be rejected. Count from the card’s expiration date or use the calculator on the form page.
What if we divorced before the window?
File I-751 on your own with a waiver request. You don’t have to wait for the window – a waiver petition can be filed any time before your status ends. Include the divorce decree and proof that the marriage was real.
My card expired and there is no decision yet. How do I prove my status?
The I-751 receipt notice together with your card extends status and work authorization for 48 months past the date on the card. If that period has also passed, contact the USCIS Contact Center.
Is an interview required?
Not always. USCIS decides whether to interview you or approve on the documents. If an interview is scheduled, both spouses attend – failing to appear without good cause ends the status.
Can my children be included in my petition?
Yes, if they became conditional residents with you or within 90 days afterwards. Otherwise they file a separate I-751.
