O-1 Visa for Individuals with Extraordinary Ability
The O-1 is a work visa for people whose achievements are recognized beyond their own employer – a researcher with cited papers, a startup founder covered by trade press, a national team coach, a cinematographer with festival awards. It is issued for a specific job in the US for up to three years and can be extended after that.
We map your evidence to the O-1 criteria, show where the case is thin, and build the I-129 petition with your US employer or agent. Legal work starts at $4,000; USCIS and consular fees are paid separately.

Send us your resume or profile with a list of awards and press. A lawyer will tell you which O-1 criteria you already meet.
Who qualifies for an O-1 visa
USCIS does not judge talent in the abstract. It looks at what you can prove. For the O-1A (sciences, education, business, athletics) you need one major internationally recognized award or three of eight criteria.
- national or international prizes for excellence
- membership in associations that admit people for outstanding achievement
- published material about you and your work in professional or major media
- judging the work of others, on a panel or alone
- original contributions of major significance – scientific, technical or business
- authorship of scholarly articles
- a critical role at organizations with a distinguished reputation
- a high salary or fee compared with others in the field
The O-1B (arts, film and television) has its own list of six – lead roles, critical reviews, commercial success, recognition from organizations and experts. When the criteria do not fit an occupation, USCIS accepts comparable evidence.
Three criteria are only the entry point. The officer then asks whether the record as a whole shows someone near the top of the field, which is why three strong exhibits beat a stack of minor certificates.
Who files the petition and what the consultation letter is
You cannot file an O-1 for yourself. The petitioner is a US employer, a US agent, or a foreign employer acting through a US agent. An agent makes sense when you have several clients; the petition then carries an itinerary with dates and locations.
Every O-1 petition needs a written advisory opinion from a peer group, union, management organization or recognized expert in your field – the consultation letter. If no such group exists for your work, the petition has to show that instead.
O-1, EB-1A or EB-2 NIW
| O-1 | EB-1A | EB-2 NIW | |
|---|---|---|---|
| Result | work visa, up to 3 years | green card | green card |
| Who files | employer or agent | you | you |
| Bar | 3 of 8 criteria | 3 of 10 plus final merits | degree plus national interest |
| Queue (Nov 2026) | none | none | April 1, 2025 cutoff |
Many people do both – enter on an O-1, work in the US and prepare an EB-1 green card or EB-2 NIW in parallel. Filing for a green card does not stand in the way of an O-1 approval or extension.

How we prepare an O-1 case
From the first review to filing usually takes one to three months; expert letters and the consultation letter take the longest.
- Criteria review. We sort your awards, press, roles and earnings under the O-1A or O-1B criteria and say plainly which ones hold and which need work.
- Choosing the petitioner. An employer with an offer, an agent, or a foreign company through an agent. We prepare the contract and job description for up to three years.
- Evidence and letters. Exhibits, translations, letters from experts who know your work first-hand, and the consultation letter.
- Form I-129. A cover brief that walks the officer through each criterion, filed with USCIS, with premium processing if you want it.
- Visa or change of status. After approval – DS-160 and a consular interview. If you are already in the US in valid status, you can change to O-1 without leaving.
A petition can be filed no earlier than one year before the job starts. If your contract begins in six months, start gathering evidence now – premium processing speeds up USCIS, not the paperwork on your side.
- passport, resume and degrees
- awards, certificates, invitations to judge
- articles about you with link, date, author and translation
- contract or offer with a job description
- expert letters and the consultation letter
- proof of pay if you rely on the salary criterion

Which evidence is weak
The most overrated items are paid features and memberships you join by paying a fee. Officers can tell an editor’s story about your project from an advertorial. A quick test – would this outlet have written about you if nobody paid? If not, do not build the petition around it.

O-1 visa questions
How long is an O-1 valid?
The petition covers the work period, up to three years. After that, stay is extended in increments of up to one year while the same work or project continues, with no cap on the number of extensions. More on timing in our article on how to get an O-1 talent visa.
I am Canadian. Do I need a visa stamp?
No. Canadian citizens do not need an O visa, but they still need an approved I-129 petition and present it at the port of entry. If you hold a profession on the USMCA list, a TN may be a simpler option – worth comparing before you start.
Can I work for several clients?
Yes, through a US agent who files one petition with an itinerary listing the clients, dates and places. Work outside the petition is not allowed.
What about my family?
Your spouse and unmarried children under 21 get O-3 status for the same period. They can study, but cannot work in O-3 status.
How is the O-1 different from the H-1B?
The H-1B depends on a lottery and a specialty degree; the O-1 depends on documented achievement. There is no cap or lottery for the O-1.
Can I apply for a green card while on an O-1?
What if the job ends early?
You get up to 60 days to find a new petitioner, change status or leave. A new employer files a new petition.
